Important Notices

Binding agreement. By creating an account, placing an order, or using any Episanare service, you agree to be bound by these Terms.

Not medical services. Episanare is a wellness company, not a healthcare provider. Nothing we provide creates a doctor-patient relationship.

FDA disclaimer. Our products and services have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.

Arbitration & class-action waiver. Sections 14 and 15 contain a binding arbitration clause and class-action waiver. You may opt out within 30 days of first accepting these Terms by emailing legal@episanare.com.

1. Eligibility and Account Registration

You must be at least 18, a legal resident of a jurisdiction where our services are available, and have legal capacity to contract. You are responsible for keeping your credentials confidential. One account per person; no transfers.

2. Description of Services

2.1 Epigenetic Testing — DNA methylation analysis via a CLIA-certified laboratory partner: Starter (one-time), Pro (subscription), Elite (annual programme with longevity advisor).

2.2 Protocol & Recommendations — personalized wellness recommendations across nutrition, supplementation, exercise, sleep, and stress, generated by our AI engine. Wellness suggestions only — not medical advice.

2.3 Coaching — Pro and Elite tiers include wellness coaching calls. Coaches are not licensed clinicians.

2.4 Partner & Clinic Services — governed by separate executed agreements.

3. Wellness Services — Not Medical Services

Our reports are wellness assessments, not diagnoses. Our protocols are suggestions, not prescriptions. Always consult a licensed healthcare provider before making health decisions based on our reports.

4. Ordering, Payment, and Subscriptions

4.1 Orders. You confirm your information is accurate and that you meet eligibility requirements. We may refuse or cancel orders.

4.2 Pricing. Prices are in USD and subject to change with notice. We honor the price at the time of a confirmed order.

4.3 Subscriptions. Episanare Pro is billed monthly and renews automatically. You may cancel any time; cancellation takes effect at end of the current period. Price increases are emailed at least 7 days in advance.

4.4 Refunds. Unactivated kits: full refund within 30 days. Activated but sample not yet received: store credit. Analysis complete: no refund. Defective kits or lab errors are replaced at no charge.

5. Biological Sample Submission

You confirm the sample is your own, collected per our instructions; you authorize lab analysis; submitting another person's sample without their consent is prohibited and may have legal consequences.

6. Acceptable Use Policy

You agree not to: violate applicable law; provide false information; submit others' samples without consent; reverse-engineer our Services; scrape without authorization; disrupt our systems; copy our content without permission; build competing products; or harass other users.

7. Intellectual Property

7.1 All content and algorithms are the exclusive property of Episanare Inc. or its licensors. You receive a limited, non-exclusive, revocable license for personal, non-commercial use.

7.2 Your Data. You own your personal data, including your epigenetic data, and grant us a limited license to process it to provide and improve our Services.

7.3 Feedback. Feedback you submit is licensed to us perpetually and royalty-free.

8. Third-Party Services

Integrations with Apple Health, WHOOP, Oura, and laboratory partners are subject to those third parties' terms. You may disconnect any integration through your account settings.

9. Disclaimers and Limitation of Liability

9.1 Services are provided "as is" and "as available" without warranty of any kind to the maximum extent permitted by law.

9.2 To the maximum extent permitted by law, Episanare is not liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed the greater of (a) amounts you paid us in the preceding 12 months or (b) US $100.

10. Health-Related Risks

Learning your biological age may cause psychological distress for some individuals. Discuss any supplement, dietary, or exercise changes with your doctor, especially if you have existing conditions, take medications, or are pregnant or breastfeeding.

11. Indemnification

You agree to indemnify Episanare from claims arising from your violation of these Terms, applicable law, third-party rights, false information, or unauthorized sample submission.

12. Term and Termination

These Terms remain in effect while you use our Services. We may suspend or terminate for material breach, fraud, unauthorized sample submission, or non-payment. Sections 7, 9, 11, 13–16 survive termination.

13. Informal Dispute Resolution

Before formal action, you agree to contact legal@episanare.com to seek informal resolution. We will work in good faith for 30 days.

14. Binding Arbitration

Most disputes are resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules, in Delaware or by videoconference. Opt out within 30 days by emailing legal@episanare.com with subject "Arbitration Opt-Out." Claims for injunctive relief on IP and claims not subject to arbitration may be brought in court.

15. Class Action & Jury Trial Waiver

To the fullest extent permitted by law, you and Episanare each waive the right to a jury trial and to participate in class actions, class arbitrations, or representative proceedings.

16. Governing Law

Governed by the laws of the State of Delaware, USA, without regard to conflicts of law. Subject to Section 14, you consent to exclusive jurisdiction of Delaware state and federal courts.

17. General Provisions

Entire agreement; severability; no waiver by non-enforcement; no assignment by you without our consent; force majeure; consent to electronic communications; legal notices to legal@episanare.com (subject "Legal Notice"). We may modify these Terms with at least 30 days' email notice for material changes.
